1. Overview of Vivid Voice

Vivid Voice is a self-reflection and wellbeing application that lets you record voice journals, set and track goals, rate daily moods, view progress calendars, build vision boards, celebrate achievements, create custom prompts, and track weekly mood averages.

Important Disclaimers: Vivid Voice is for personal wellbeing and productivity. It is not a medical device, diagnostic tool, crisis service, or FDA-approved treatment.

2. License Grant

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Vivid Voice on Apple-approved devices you own or control.

What You May Do

  • Use the App for personal, non-commercial purposes
  • Install on devices linked to your Apple ID
  • Create, store, and manage your personal content
  • Access premium features with an active subscription

What You May Not Do

  • Copy, modify, reverse-engineer, or decompile the App
  • Bypass security or authentication
  • Use the App commercially without permission
  • Redistribute, resell, or sublicense the App
  • Create derivative works or use bots/scrapers
  • Interfere with the Service or impersonate others

This App is licensed, not sold. You do not own the software.

3. Account Registration & Security

Creating an Account

  • Provide a valid email
  • Create a secure password (8+ chars: upper, lower, digit, special)
  • Verify your email via 6-digit OTP (valid 10 minutes)
  • Be at least 13 years old (or local minimum)

Account Security

  • Maintain password confidentiality
  • Monitor activity on your account
  • Notify us of unauthorized access
  • Log out on shared devices

We are not liable for losses from unauthorized use.

Account Accuracy & Termination

Provide accurate information and update as needed. We may suspend or terminate for violations, fraud, abuse, illegal use, harassment, or inactive subscriptions.

4. Cloud Storage & Data Handling

All user-generated content is uploaded to AWS S3 via secure HTTPS APIs.

What Gets Stored

  • Voice recordings (m4a, mp3, wav, aac, ogg – up to 50MB)
  • Images (jpg, jpeg, png, heic, gif – up to 10-100MB)
  • Videos (mp4, mov, avi, wmv – up to 100MB)
  • Text journal entries (up to 5,000 characters)
  • Daily mood ratings

Storage Security

  • AES-256 encryption at rest
  • TLS/HTTPS in transit
  • Private buckets; signed URLs (30-minute expiry)

Connectivity & Limits

Requires active internet; uploads depend on network speed and file size; offline functionality is limited. Files over limits are rejected.

Data Availability & Deletion

Deleting the app does not delete stored content. Delete items in-app or request full account deletion (see Privacy Policy). Deleted data cannot be recovered.

5. User Responsibilities & Prohibited Content

Acceptable Use

Do not upload illegal, harmful, hateful, explicit, violent, or infringing content; avoid malware and malicious code. Respect others' rights and do not misuse the Service (spam, DDoS, fake accounts, data access attempts).

Monitoring & Consequences

We may review flagged content, remove violations, report illegal content, and suspend or terminate accounts for violations.

6. User-Generated Content Ownership

You retain full ownership of your content (audio, images, videos, text, goals, visions, achievements). You grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit, display, back up, and operate the Service. We will not sell or use your content for ads.

Upon deletion, our license ends; content is removed from active storage within 7 days and backups within 30 days.

7. Subscription Terms & Payments (Apple IAP)

Plans & Billing

Auto-renewing subscriptions for premium features. Payment via Apple; currency per Apple ID country. We do not store card data.

Auto-Renewal & Management

Renews unless canceled 24 hours before period end. Manage via Apple subscription settings; access continues through current period.

Trials, Refunds, Price Changes

Trials convert to paid unless canceled. Refunds handled by Apple only. Price changes with notice; cancel if you disagree.

8. Disclaimers & Limitations

Not medical advice or a therapeutic tool; results not guaranteed; service may face interruptions; third-party services may fail; beta features are as-is.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages. Total liability is capped at the greater of $100 USD or amounts paid in the prior 12 months. Exceptions may apply based on jurisdiction.

10. Termination of Use

You may delete the app, cancel subscription, or request account deletion. We may suspend or terminate for violations, fraud, illegality, inactivity, legal requirements, or to protect the Service. Subscriptions remain active through the billing period; data handled per retention policy.

11. Intellectual Property Rights

We own the app, code, design, name, logo, default prompts, and materials. You own your generated content and custom prompts. Do not copy or misuse our IP. DMCA notices: developervividvoice@gmail.com.

12. Changes to These Terms

We may update Terms with a new Last Updated date and notify via in-app or email for material changes. Continuing use means acceptance. Version history: v1.0 (Dec 9, 2025).

13. Miscellaneous

Entire agreement with Privacy Policy; severability; no waiver unless in writing; assignment limits; force majeure; export controls; English prevails; App Store terms acknowledge Apple as third-party beneficiary.
